Terms & Conditions
1. TERM
This Agreement shall commence on the date the products (as
detailed in the Schedule) (“Product(s)”) are delivered to the Customer and will
remain in effect until the fixed period [corresponding to the tenure agreed
upon by the Customer during the booking of the Product(s)] expires and the
Products are returned to Rentofab, unless terminated earlier or extended as per
the Flexi Tenure policy.
2. FLEXI TENURE POLICY
Rentofab offers a flexible tenure (“Flexi Tenure”) option for early closure or extension of the Agreement term. For early closure, the Customer can inform Rentofab any time before the desired closure date. Different monthly rental rates are available based on the selected tenure at the time of booking. Early closure charges (detailed on the Rentofab website) will be up to the total amount of the security deposit paid by the Customer, excluding any rental dues and damage charges. Extensions beyond the initial tenure will follow the applicable monthly rate at the time of extension. All changes must be made via the Rentofab website and will be deemed part of this Agreement. Rentofab reserves the right to revise rental rates at any time at its discretion.
3. PAYMENTInvoices are issued on the 1st of each month, with payment due by the 10th ("Due Date"). Late payments will incur a 10% late fee starting from the 11th of the month on the overdue amount. Pro-rata calculations will apply for partial months at the start or end of a rental period. Payments must be made directly to Rentofab. Rentofab may share payment history with credit rating agencies and reserves the right to contact the Customer's network in case of default.
4. SECURITY DEPOSITIn addition to the monthly rental, a refundable security deposit ("Security Deposit") is required. This deposit does not accrue interest. After product pickup and a quality check, the deposit will be refunded within 15-21 working days, minus any deductions for damages or dues. Rentofab has the right to deduct any unpaid rental dues or damage costs from the Security Deposit.
5. ORDER CONFIRMATIONUpon receipt of the order and Security Deposit, Rentofab will confirm the order via email. If any ordered product is unavailable, Rentofab may offer a substitute, which the Customer can accept or decline. KYC verification and serviceability checks are required before delivery. Rentofab may reject orders if verification fails or if the location is not serviceable.
6. DELIVERYOnce an order is confirmed, Rentofab will deliver the Products to the specified address. The Customer or an authorized representative must be present at delivery. Extra charges may apply for repeated delivery attempts. Quality checks will be conducted before delivery. If any damage is noticed post-delivery acceptance, Rentofab will not be liable.
7. DAMAGEThe Customer is liable for any damages, theft, or loss of the Product. Minor scratches and wear will be assessed against pre-delivery documentation. Unauthorized repairs or alterations will incur penalties. A damage report will be sent to the Customer after product return.
8. DAMAGE WAIVERRentofab offers a damage waiver benefit based on tenure:
- 6-12 months: Rs. 250
- 13-24 months: Rs. 500
- 25-36 months: Rs. 1000
The waiver is subject to timely payments.
9. MAINTENANCERentofab will provide maintenance for the rented Products throughout the Agreement or upon request. Annual cleaning is available after 12 months. Damages not due to normal wear will be chargeable.
10. INSPECTIONRentofab reserves the right to inspect rented Products during the Agreement term. Advance notice will be provided for inspections.
11. RELOCATIONFor relocation, the Customer must notify Rentofab two weeks in advance, providing proof of the new address. Relocation is subject to KYC verification and serviceability. Unserviceable locations will be treated as early closures.
12. TERMINATIONThe Agreement ends on the last day of the rental term unless extended. Rentofab may terminate the Agreement for payment defaults or other breaches. Upon termination, Rentofab will retrieve the Products and refund the Security Deposit, subject to damage assessments.
13. OWNERSHIP OF PRODUCTSProducts remain the property of Rentofab or its partners. This Agreement does not transfer ownership to the Customer.
14. ASSIGNMENTThe Customer may not transfer this Agreement without written consent. Rentofab may assign the Agreement to third parties.
15. ADVANCE RENTALAdvance rental credited as Rentofab credits is non-refundable but can be applied to future subscriptions.
16. INDEMNIFICATIONThe Customer agrees to indemnify Rentofab against claims, damage, or liability related to Product use, except when due to Rentofab’s negligence.
17. GOVERNING LAWThis Agreement is governed by Indian law and is subject to the exclusive jurisdiction of courts in the relevant jurisdiction.
18. ENTIRE AGREEMENTThis Agreement, along with any attachments, constitutes the entire understanding between Rentofab and the Customer. It supersedes previous agreements. Terms on the Rentofab website take precedence in case of conflicts.
19. LIMITATION OF LIABILITYRentofab’s liability is limited to the total of one month’s rental. Rentofab is not liable for indirect, incidental, or consequential damages.
DISCLAIMERRentofab reserves the right to cancel orders before delivery and will refund deposits within 7-10 working days. Any order cancellations do not impact other current or future orders.
